1. Acceptance of Terms

By downloading, installing, or using BurnRate ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

BurnRate is a macOS application that calculates and tracks meeting costs in real time based on user-provided salary and attendee data. The App operates entirely on your local device and does not require an internet connection for core functionality.

3. License

Upon purchase, ShiftPoint grants you a non-exclusive, non-transferable, revocable license to use BurnRate on any Mac computers that you own or control, subject to the Mac App Store's standard licensing terms and these Terms of Service.

4. One-Time Purchase

BurnRate is sold as a one-time purchase. There are no subscriptions, recurring fees, or in-app purchases. Lifetime updates are included with your purchase for the current major version of the App.

5. User Responsibilities

You are responsible for:

• Providing accurate salary and attendee data for cost calculations
• Ensuring that your use of the App complies with your employer's policies
• Maintaining the security of your device and the data stored by the App
• Using cost reports and summaries in a professional and appropriate manner

6. Data & Privacy

All data entered into BurnRate is stored locally on your Mac. ShiftPoint does not collect, store, or transmit any user data. For full details, please see our Privacy Policy.

7. Accuracy Disclaimer

Meeting cost calculations provided by BurnRate are estimates based on user-provided salary data and meeting duration. These calculations are intended for informational and illustrative purposes only. ShiftPoint does not guarantee the accuracy of any cost estimates and shall not be held liable for decisions made based on the App's calculations.

8. Intellectual Property

BurnRate, its logo, design, code, and all associated intellectual property are owned by ShiftPoint. You may not reproduce, distribute, modify, reverse-engineer, or create derivative works based on the App without prior written consent from ShiftPoint.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ShiftPoint shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of or inability to use the App.

In no event shall ShiftPoint's total liability exceed the amount you paid for the App.

10. Warranty Disclaimer

BurnRate is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. System Requirements

BurnRate requires macOS 14 Sonoma or later. Both Apple Silicon and Intel-based Macs are supported. ShiftPoint does not guarantee compatibility with future macOS versions, though we intend to maintain compatibility through lifetime updates.

12. Termination

ShiftPoint may terminate your license to use BurnRate if you violate these Terms. Upon termination, you must delete the App and all copies from your devices.

13. Changes to Terms

ShiftPoint reserves the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
